Absent a health shock, Alito has shown no public indication he intends to leave before the 2026 calendar year closes.

    • At 76, he is younger than several recent late-career retirements, and his current term runs through June 2027.
    • A qualifying result requires Alito or an authorized representative to make an explicit public announcement by December 31.
    • The odds would rise sharply on credible reports of deteriorating health or a late-2026 announcement tied to a successor nomination.

Alito's age and health are the only real drivers; he has shown zero inclination to step aside and has ~3.5 months left.

    • Alito is 76 and has repeatedly signaled he intends to serve for the foreseeable future, including statements as recent as 2025 pushing back on retirement speculation.
    • The window is only ~3.5 months (Sep 19 – Dec 31, 2026); justices typically announce retirements in late spring/early summer to align with term end, making a fall…
    • A sudden health event or a dramatic political shift (e.g., a credible threat to court legitimacy he feels compelled to address) would move this sharply, but neither is…

Turns on whether Alito, age 76, chooses to retire strategically while a GOP president/Senate can confirm a successor.

    • Republicans control the presidency and Senate through 2026, giving strategic incentive to retire now rather than risk losing that control.
    • No public signals or health issues have emerged suggesting imminent retirement as of September 2026.
    • Justices often serve years beyond age 76; base rate for a specific justice announcing retirement in any given 15-month window is low, maybe 8-12%.

Alito is 76 and has shown zero signals of stepping down; a mid-term retirement announcement in the next 14 weeks would be unprecedented.

    • Justices almost always announce retirements in late spring/early summer after the term ends, not in the fall; the window here is only ~14 weeks.
    • Alito has publicly resisted retirement pressure, told interviewers he has no plans to go, and conservatives fear replacing him under Trump without a confirmed successor.
    • Base rate for a specific sitting justice announcing retirement in any given 3-month stretch is roughly 3-5%; Alito sits below that given his stated intent to stay.

Alito must himself announce a vacancy in the next 103 days with no prior signals.

    • He is 76, healthy enough to author opinions through OT 2025, and has given no public hint of departure.
    • A GOP White House and Senate already exist, so delaying past 2026 midterms or into 2027 carries little risk.
    • Justices announce retirement in any given quarter at a ~2% base rate; nothing here raises it.

Alito is unlikely to step down during an active fall sitting when conservative political alignment remains stable.

    • Retirement announcements overwhelmingly occur at the close of terms in June or July, leaving only a short off-cycle window by year-end.
    • At 76, Alito remains intellectually vigorous and historically resistant to outside public pressure or media-driven retirement nudges.
    • A sudden health emergency is the only plausible catalyst for an unexpected announcement between late September and December 31.
